What Is a Wrongful Death Case in Norfolk?

A wrongful death case allows the personal representative of a deceased person’s estate to bring a claim when a death is caused by negligence or a wrongful act. If the individual could have pursued a personal injury claim had they lived, that claim can be filed as a wrongful death lawsuit on their behalf. Under Virginia law, families may seek compensation for both financial losses, such as medical and funeral expenses, and emotional losses, including loss of companionship.

Types of Fatal Accidents That Lead to Wrongful Deaths in Norfolk

Wrongful death cases in Norfolk often stem from different kinds of fatal accidents, each involving negligence or a wrongful act that causes a preventable loss of life.

  • Motor vehicle accidents: Fatal outcomes from car accidents, truck accidents, or motorcycle accidents often involve negligence, like impairment or drunk driving.
  • Medical malpractice: When a healthcare provider’s mistakes lead to death, families may pursue a wrongful death claim. These cases are subject to Virginia’s cap on total damages, which limits the maximum compensation available.
  • Premises liability: Deaths from unsafe property conditions, like slips or negligent security, can support wrongful death claims.
  • Criminal acts: Families may pursue civil claims when a violent or intentional act leads to death, in addition to criminal justice.

Who Can Receive Wrongful Death Compensation in Norfolk, Virginia?

In Virginia, only the personal representative of the deceased person’s estate may file a wrongful death claim. Compensation is then distributed to eligible family members, such as a spouse, children, or parents. In some cases, other close relatives may qualify. If a jury doesn’t decide how the compensation should be divided, the court steps in to make sure the distribution is fair under Virginia law.

Steps to Take After a Wrongful Death in Norfolk

After the loss of a loved one, certain steps can help protect your family’s rights and prepare for a potential wrongful death claim:

  • Contact a Norfolk wrongful death lawyer promptly.
  • Preserve important evidence, including medical records, accident reports, and witness statements.
  • Obtain the death certificate and appoint a personal representative for the estate.
  • File the claim before Virginia’s two-year statute of limitations expires.
  • Allow your attorney to handle communication with insurance companies.

Taking these steps early can strengthen your case and relieve your family of additional stress. Speaking with Montagna Law’s wrongful death attorneys gives you the guidance and support needed to move forward during this difficult time.

Why Contacting a Wrongful Death Attorney Quickly Matters

Time is critical in wrongful death cases. Acting quickly gives your attorney the chance to preserve evidence, meet important deadlines, and respond to insurance companies before they gain an advantage. Reaching out to Montagna Law as soon as possible helps protect your family’s ability to pursue justice and fair compensation.

What Must Be Proven to Win a Wrongful Death Case?

For a wrongful death claim to succeed, the following elements must be proven with reliable evidence:

  • The defendant owed a legal duty to the deceased.
  • The duty was breached through negligence or intentional misconduct.
  • The breach directly caused the death.
  • Surviving family members experienced measurable losses.

At Montagna Law, our Norfolk wrongful death attorneysgather evidence, consult with experts, and organize every part of the case to present a strong and legally sound claim.

Types of Compensation You Can Receive for a Wrongful Death Case

Families pursuing a wrongful death claim may seek compensation for both financial and emotional losses, including:

  • Medical expenses and funeral or burial costs.
  • Lost income and benefits the deceased would have provided.
  • Loss of services, care, and companionship.
  • Pain and suffering experienced by surviving family members.
  • Punitive damages in auto accident cases involving reckless conduct, such as drunk or impaired driving, may be available in some cases. Virginia law limits punitive damages to a maximum of $350,000.

At Montagna Law, we tailor each claim to reflect the specific losses your family has endured under Virginia law.

How Long Do I Have to File a Wrongful Death Claim in Norfolk?

In Virginia, wrongful death claims must be filed within two years from the date of death. Missing this deadline can result in losing the right to pursue compensation. Speaking with a Norfolk wrongful death lawyer as soon as possible helps protect your family’s ability to take legal action.

I got into a little jiffy with the Portsmouth police for excessive speeding. Mr. Montagna helped me tremendously. He got my charges drop by a lot and did a great deal with the pricing. He is affordable and helps you to the best of his ability (which is a lot). I would recommend him to anyone that needs help!

Attorney Montagna was excellent in handling my first-ever speeding ticket in Virginia Beach. I'm so glad I sought help from Montagna Law instead of just paying it online and accepting the points. He was responsive and guided us through every step, ultimately getting the case dismissed. We are thrilled with the outcome and recommend him with the highest possible enthusiasm!

Sometimes your young adult driver buys a motorcycle and discovers speed limits aren’t an option. Sometimes, that lesson takes a few reckless tickets. Mr. Montagna helped guide her through the process, consequences, and worked exceptionally hard in court to get these charges lessened, even when additional tickets accumulated. He’s straightforward, makes sure you understand both consequence and action to represent his client in the best light possible. What felt like the end of the world for my family turned out much better than expected with Mr. Montagna’s guidance, experience, and knowledge.

I needed assistance with a speeding ticket in VA that I received while returning from a work trip. They were great about helping me understand VA laws and what needs accomplishing to get the ticket reduced. I worked with Anthony Montagna and he was able to even give advice according which judge was likely to be working that day. He also made the trip to court twice - once right after a snow storm when that one court house was the only one to not announce they were closed due to weather. We were one of about 20 parties to show up due to the lack of communication from the courthouse but I didn't have to worry about rescheduling, he work with the courts on that and our second trip was successful. I am grateful for the free evaluation and practical advice. I hope I never need them, or any lawyer, again, but if I do, I would not hesitate to use them again.

Being ready for court is what it is all about. He will tell you exactly what you need in preparation, i.e. community service, driving classes, paperwork, etc. If you do as he says, you will get the results you want. Choosing the right lawyer makes a big difference. If you like to drive fast, keep him on speed dial.
